Onion Terms and Conditions
1About these terms
Onion is a web-based Kanban board application (the "Service"), available at getonion.app and app.getonion.app. These Terms and Conditions (the "Terms") govern the use of the Service. By creating an account or using Onion, the user accepts these Terms. If the user does not agree, they must not use the Service.
2Definitions
- Service: the Onion web application and all of its features.
- User: the person who creates an account and uses the Service.
- Content: the boards, columns, cards, attributes and any data the User creates or uploads to Onion.
- Public boards: boards the User chooses to make accessible through a public URL (
/p/:slug).
3Your account
To use Onion it is necessary to create an account with Google or with an email and password. The user is responsible for keeping their credentials confidential and for all activity that occurs on their account.
To use Onion it is necessary to be at least 16 years old. Anyone who does not meet that age may not create an account.
The user agrees to provide accurate information when registering and to keep it up to date.
4Prohibited conduct
It is not permitted to use Onion to:
- Upload, publish or share content that is illegal, harmful, defamatory, or that infringes the rights of third parties.
- Breach the security of the Service or attempt to access accounts or data belonging to others.
- Use the Service to send spam, malware, or carry out fraudulent activities.
- Overload or interfere with the Service's infrastructure.
- Resell, sublicense or commercially exploit the Service without authorization.
5Communications
By creating an account, the user agrees to receive the emails necessary to operate the Service, such as confirmations, security notices, account changes and important notifications about how Onion works. These emails are part of the Service and cannot be turned off while the account is active.
Marketing communications, such as product news or usage tips, are optional. They are only sent if the user gives their consent separately, and the user can unsubscribe at any time.
6Your content is yours
The Content created in Onion belongs to the user. Onion does not claim ownership over the boards or over the information uploaded. The Content is not sold nor used for commercial purposes.
In order to display the Content, store it and operate the Service, the user grants Onion a limited license, solely for that purpose. This license exists only to make the Service work and ends when the Content or the account is deleted, except for temporary technical copies that may remain in backups for a limited time.
7Public boards
Boards marked as public are accessible through a URL (/p/:slug) without the need for authentication. The user is responsible for the content they choose to make public and understands that this content may be accessed, shared and indexed by search engines.
Onion does not control or pre-review the content of public boards. The user can make a board private again at any time, which does not necessarily remove copies already indexed or previously accessed by third parties.
8Personal data
Onion does not sell personal data or hand it over to third parties for commercial purposes. Data is shared only with the providers necessary to operate the Service (such as infrastructure, database, authentication and analytics), to the extent necessary to provide the Service.
The processing of personal data is governed by Onion's Privacy Policy, which forms part of these Terms and details the data subject's rights (access, rectification, cancellation, objection and portability) in accordance with Law 21.719.
9Moderation and illegal or harmful content
Onion reserves the right to review, restrict or remove Content, and to suspend or close accounts, when there is illegal or harmful material, or material that threatens the Service, its infrastructure or third parties.
In cases of serious risk or legal requirement, Onion may act immediately. In all other cases, it will endeavor to notify the user through a reasonable means when possible.
10Onion's intellectual property
The Service, including its code, design, interface, logo and the name "Onion", are the property of Onion and are protected by applicable laws. These rights exist even without a formal registration, with respect to copyright over the code and the design.
These Terms do not transfer any right over Onion's intellectual property beyond using the Service in accordance with these Terms.
11Pricing
Today the Service is free. This does not mean it will always be. Onion reserves the right to introduce paid plans, modify the features available in the free plan, or change the commercial conditions in the future. If relevant changes are made that affect the user, notice will be given with reasonable advance notice.
12Service provided "as is"
The Service is provided "as is" and "as available", without warranties of any kind. It is not guaranteed that the Service will be available continuously and uninterrupted, that it will be free of errors, or that it will fit a specific purpose.
13Limitation of liability
To the maximum extent permitted by applicable law, Onion will not be liable for indirect, incidental, special or consequential damages, nor for loss of data, loss of profits or business interruption, arising from the use or the inability to use the Service.
This includes unforeseen events outside Onion's reasonable control, such as failures of infrastructure providers, service outages, cyberattacks or force majeure events.
Nothing in these Terms limits liabilities that cannot be legally excluded.
14Account suspension and deletion
The user can delete their account at any time.
Onion may suspend or delete an account if the user breaches these Terms, especially in the cases described in section 9.
When an account is deleted, whether at the user's request or by Onion's decision, the customary notices will first be sent by email and/or within the application. After that period, the account and its associated Content are deleted, except for temporary technical backups or information that must be retained by legal obligation.
15Changes to these Terms
Onion may update these Terms when necessary. If the changes are relevant, notice will be given through a reasonable means. The date of the last update appears at the top of the document.
16Governing law
These Terms are governed by the laws of the Republic of Chile. Any dispute will be submitted to the competent courts of Chile, without prejudice to the rights granted to consumers by law.
